Owner’s Independent Duty. Owner acknowledges and agrees that it has an independent duty to comply with its duties as owner under applicable law for asbestos abatement, including but not limited to WAC 296-62-07721 and 40 C.F.R. pt. 763. Owner further acknowledges and agrees that Puget Sound Abatement’s scope of duties does not include advising owner on its duties under applicable law for asbestos abatement, and that even if such advice is furnished, it is not relying on the advice because owner will independently verify its obligations.
Hold Harmless. Owner agrees to defend, hold harmless, and indemnify Puget Sound Abatement for any claim arising from or related to owner’s failure to (i) conduct a good faith inspection to determine whether materials to be worked on or removed contain asbestos; (ii) obtain and/or maintain a copy of a written report documenting the good faith inspection; (iii) furnish a copy of required written reports or written statements to contractors submitting a bid to undertake any construction, renovation, remodeling, maintenance, repair, or demolition project; (iv) inform employers, prospective employers, employees, prospective employees, tenant, prospective tenants or others reasonably requiring notice of the presence or hazards of asbestos; and/or (v) maintain and post records, signs and labels related to asbestos. Owner’s duty to defend, hold harmless, and indemnify Puget Sound Abatement shall not apply to the negligent acts of Puget Sound Abatement.
